In the heart of West Asembo ,Nyagoko Village , one Mama Serine Achieng has not known peace for long time.
Luckily as they say, God’s time is the best, she attended one of PRIP sustained legal community clinics at Nyagoko Secondary School. Her time to know peace had arrived and very fortunately, locally through PRIP under WVL project supported by URAIA Trust and Care Kenya.
I lived away from home for a period of about 30 years .Upon the passing on of the husband and the bread winner of the family, I had to relocate to the village with my four daughters. The family provided a place for burial of their kin in their ancestral homestead.
Hell broke loose when after one month I requested to relocate to the late husband parcel of land as to construct a homestead. I was taken round in circles as to which specific plots were my late husband’s .After engaging more of the family members , I discovered that all our parcels had been sold to third parties by my elder brother in law.
None in the community had the guts to face the in-law seller either because of his arrogance or corrupt nature that ensured the area chief and his assistant were all in his pocket and payroll.
I proceeded to launch the case with the DO’s Office but there was no forthcoming solution as the D.O referred back the case to the buyer to continue utilizing the land as they tried to sort my issues out.
I waited and gave up. I then resolved to relocate to the nearest market centre to take a living where life became extremely unbearable. It is during this period of hopelessness and despair that I was invited by a friend to attend the legal clinic organized by PRIP. PRIP took up the case did a background due diligence to establish the true position. Truly I had been disenchanted and totally so.
PRIP organized for a meeting between myself, my brother in law, the buyer the assistant chief and the area chief. The meeting did not resolve the matter. The buyer was steadfast that the matter can only be resolved in court.
PRIP took the case to land registrar and the registrar of lands has issued all the prerequisite documents to assist in my case. PRIP provided with a lawyer and the case is in court. The good news is that, the court has given orders that have allowed me to use the land as the case proceeds.
I am a very happy woman since finally I have got justice through PRIP’s intervention and the financial support from URAIA Trust, Care Kenya, CREAW, Urgent Action Fund Africa, Crawn Trust and the Government of Netherlands. The court has ruled in my favor and the land title be reverted back to my name and I can now have my land back. Thank you all and may God Bless you.
